SC Grants Women Authority To Request Haq Mehr Any Time

The Supreme Court (SC) has mandated that husbands are obligated to pay haq mehr to their wives upon request. This decision was reached following a plea by Khalid Parvez, who contested the Shariah provision granting this right to his wife. Chief Justice of Pakistan (CJP), Justice Qazi Faez Isa, penned the three-page verdict released by the SC.

According to the written verdict, the demand for haq mehr is a Shariah stipulation protected by Pakistani law. If the time for haq mehr payment is unspecified in the Nikkah, the woman holds the right to request it whenever needed.

Notably, this specific case of a woman seeking haq mehr payment based on her Shariah right took six years to reach the Supreme Court. CJP noted that the complainant pursued multiple legal avenues against the haq mehr provision before reaching the SC.

Ultimately, the SC dismissed Khalid Parvez’s plea and highlighted that had the complainant faced fines from lower courts, the matter may not have escalated to the Supreme Court.

It’s worth noting that the SC imposed a fine of Rs100,000 on the man during the case’s last hearing.
